At Tidio, we take anti-spam enforcement very seriously. This article explains the anti-spam requirements for our email tools.

CAN-SPAM Act

Before we dive into the anti-spam regulations – please make sure you are familiar with our article on the General Data Protection Regulations to ensure you are protecting your customers’ data.

The Unsolicited Advertising and Marketing Control Act of 2003, also known as the CAN-SPAM Act, was signed to protect email recipients from unwanted emails from brands and businesses.

The law does not apply only to mass emails. It covers all commercial messages, which the law defines as “any email message whose primary purpose is to advertise or promote a commercial product or service,” including emails that promote content on commercial websites. The law does not distinguish between business emails and business-to-business emails.

All emails you send with Tidio’s email tool must comply with the US CAN-SPAM Act , even if your business is registered outside the United States. Below, you can see how to make sure you comply with the CAN-SPAM Act.

Key Requirements of the CAN-SPAM Act

Here you will find some of the most important sections of the CAN-SPAM Act that we ask you to follow.

Don’t use false or misleading title information.

The original domain name and email address must be accurate and clearly identify the person or business. To set your operator name, go to Settings> invoice> Details in this section. However, to change your URL, go to Settings> invoice> Preferences in sections in your Tidio admin panel.

Don’t use misleading titles.

Your message title must accurately reflect the content of the message.

Identify the message as an advertisement

You must clearly disclose that your message is an advertisement if you send promotional emails.

Let your message recipients know where you are

Your message must include your legal physical address. Please make sure your address is set up correctly in Settings.> Campaigns> Address in the section of your Tidio admin panel.

Allow recipients of your messages to request to stop receiving emails from you

All emails sent from Tidio will include an unsubscribe button or link at the bottom, to allow recipients to stop receiving emails from you.

Honor cancellation requests.

Once your subscribers have requested to stop receiving further correspondence from you, you may not sell or transfer their email addresses elsewhere, not even in the form of a mailing list. The only exception is that you may transfer their information to a company you have hired to help you comply with the CAN-SPAM Act.

Monitoring what others do on your behalf

Even if another company manages your email marketing, you are still subject to legal liability and are expected to comply with anti-spam law.

summary

In conclusion, it is very important to comply with the requirements of the CAN-SPAM Act to ensure that your email marketing is legal and effective. By following these rules, you can protect yourself and your business from legal problems and maintain good relationships with your customers.
